ON THE BAIL CONDITIONS FOR NNAMDI KALU THE LEADER OF THE INDIGENOUS PEOPLE OF BIAFRA

We recall the media reports on the grant of bail to Mr. Nnamdi Kanu, the leader of the Indigenous People of Biafra by Justice Binta Nyako of the Federal High Court. It is trite law that the power to grant bail involves the exercise of judicial discretion and the criteria for the exercise has been streamlined by the decisions of Supreme Court of Nigeria in a plethora of cases [Suleiman & Anor v C.O.P. Plateau State (2008) 2-3 S.C.; Bamaiyi v The State (2001) 4 S.C. (Pt) 1 18; Dokubo Asari v Federal Republic of Nigeria (2007) 5-6 S.C 150]. While we admit that the exercise of discretion and the conditions attached to bail may vary from case to case, it must be situated within the context of constitutionalism, legality, the facts of the case and follow judicial precedent.

The bail conditions handed out to the leader of the Indigenous People of Biafra (IPOB), Mazi Nnamdi Kanu, by Justice Binta Murtala-Nyako is not only defective but also smirks of judicial recklessness, rascality, and reeks of tribal and religious bigotry. At best, the bail conditions are booby traps to perpetually gag, ensnare, and render lameduck, Mazi Nnamdi Kanu whose only crime is the peaceful demand for the enforcement of the rights of Indigenous People of Biafra to self-determination as enshrined in the 2007 United Nations Declaration on the Rights of Indigenous People (UNDRIP). We posit that Justice Binta Murtala-Nyako has brought the Nigerian Judicial System to the lowest ebb by virtue of these bail conditions.

(Intersociety, Onitsha Nigeria: 25th April 2017)-It is incurably defective and socially disastrous when a post SSCE student who scores 100 in the Joint Admission & Matriculation Board exams is admitted into the university to study a law course, for instance, with another student who scores 250 in the same exams. The former with lower mark and lower quotient is allowed admission because he or she comes from northern part of the country and benefits from the so called quota system allocations and considerations; while the latter is admitted under stringent conditions and marks requirements because he or she comes from the knowledgeable southern part of Nigeria. The consequences of the former on all spheres of Nigeria’s social development and conducts including the appointment and promotion of Judges in the country have remained irremediably grave till date.

We have taken ample time to dwell on the interview granted by Alhaji Tanko Yakassai and we have most sufficiently subjected the said interview to the forensic analysis of sapient extrapolation. Our aim is not to ridicule but rather to illuminate the darkest recesses of the unattainable ambitions of the core North in relation to Biafra. Let it be said unequivocally that Yakassai's statements are inordinately over-ambitious. The points he raised cancelled out each other, so we see it as being ill-thought out, divergent, and outrightly riotous.

I read a post from Ena Ofugara yesterday and i was shocked that in this 21st century a young man will make a post titled (BLOOD WILL FLOW) if a Referendum should be held in his Territory.

Ena Ofugara is a typical Nigerian and a Niger Deltan who sees oil as God and the only natural resources that can be used to develop a nation, but he forgets that there are so many resources in the North, West, East and South, including human resources that are left untapped by the federal government of Nigeria.

As the first Nigerian-Biafra War drew to a close in 1970, there was demoralisation everywhere across Biafra. Everyone thought that was the end. Nigerian marauding vandals were everywhere across Biafra, looting, wrecking, maiming and raping. To cap it all the wealth of Biafrans were openly stolen and used to develop other parts of Nigeria and a conscious effort was made to make sure the word Biafra was erased from the minds of the world and never spoken of.

It is no longer news that the Nigerian Army led by General Tukur Buratai has set up a purported Panel of Inquiry to investigate the multiple killings of unarmed civilians , the members of the Indigenous People of Biafra ( IPOB ). The action of the Nigerian Army in setting up the purported Panel of Inquiry was apparently compelled by the widely published report of the Amnesty International ( AI ) on the gruesome and odious massacre of over 1, 000 IPOB members across different parts especially in the South – South / South – East regions of Nigeria within the last one year.

The indigenous people of Biafra (IPOB) and it's leadership worldwide would like to use this opportunity to inform Biafrans, friends of Biafra, lovers of freedom all over the world and humanity in general, to prepare for the historic annual Biafra Day of Remembrance 2017. On the 30th of May 2017 as is now the tradition, since our leader Mazi Nnamdi Kanu held the inaugural event at our Cenotaph in Enugu on 30 May 2014, we shall honour the gallant and brave Biafran soldiers that withstood the might of the British sponsored coalition against Biafra between 1967 to 70.
